What this amendment would do
SA 5910 is an amendment intended to be added to bill S. 4784. Its purpose is to require the Secretary of State to create and publish an annual list of PRC entities involved in mining activities in Africa that use forced labor or cause environmental harm to protected areas.
The amendment aims to add a section to the bill that mandates the following:
-
Annual Reporting: For five years starting from the date the Act is passed, the Secretary of State must submit a list to the relevant congressional committees and make it public on the internet.
-
Scope of the List: The list must identify PRC entities and the specific mines, mining zones, or concessions where they are mining gold, iron, or critical minerals in countries such as South Africa, Zimbabwe, Zambia, Guinea, Nigeria, the Democratic Republic of the Congo, or any other African country.
-
Criteria for Inclusion: Entities are listed if the Secretary reasonably assesses they are:
-
Using forced labor.
-
Causing environmental harm to a protected area.
-
Development Process: The Secretary of State must use open-source information and data from U.S. embassies. The Secretary must also consult with various federal officials, including the Secretary of Labor, Secretary of Commerce, Secretary of the Treasury, the Director of National Intelligence, and foreign counterparts in the affected countries.
