What this amendment would do

This amendment, known as the Federal Carjacking Enforcement Act, aims to change section 2119 of title 18, United States Code, regarding motor vehicles.

The purpose of this amendment is to change the following:

  • It replaces the phrase "with the intent to cause death or serious bodily harm" with "knowingly" in the matter preceding paragraph (1).

  • It updates paragraph (2) to state that a person may be fined or imprisoned for up to 25 years, or both, if they take or attempt to take a motor vehicle with the intent to cause death or serious bodily harm, or if they brandish or discharge a firearm during or in relation to the act, and serious bodily injury results.

  • It modifies paragraph (3) to specify that the penalty applies if the person taking or attempting to take the motor vehicle does so with the intent to cause death or serious bodily harm, and death results.
