What this amendment would do
The amendment, titled the Falun Gong and Victims of Forced Organ Harvesting Protection Act, aims to add a new subtitle to bill S. 4784. Its purpose is to address and penalize forced organ harvesting within the People's Republic of China.
Key Changes and Additions:
-
Sanctions: It requires the President to create a list of foreign persons who have knowingly and directly engaged in or facilitated forced organ harvesting in the People's Republic of China. These individuals would face the blocking of their property in the U.S. and be deemed inadmissible to the United States, including the revocation of existing visas.
-
Investigations and Reporting: It expresses the sense of Congress that the U.S. Government should investigate these allegations and condemn non-consensual organ procurement. It also mandates a report from the Secretary of State (consulting with other agencies) to determine if the Chinese government engages in systemic forced organ harvesting and if such practices constitute an "atrocity."
-
Accountability: The amendment requires a list of all U.S. grants from the previous 10 years that supported organ transplantation research in the People's Republic of China or collaborations with Chinese entities.
-
Limits and Exceptions: The authority to impose sanctions expires 5 years after the Act is enacted. Sanctions do not apply to the importation of goods, humanitarian assistance (such as food and medicine), or authorized U.S. intelligence and law enforcement activities. The President also has the authority to waive sanctions based on national security interests.
