What this amendment would do
As folks working for you in Congress, we need to keep a close eye on the rules being made. Mr. Merkley submitted SA 581, which is an amendment meant to be added to the congressional budget for the United States Government for fiscal year 2025 and budgetary levels for fiscal years 2026 through 2034.
What The Amendment Aims To Change
This amendment adds a new rule to the Senate. Its main purpose is to stop the imprisonment of children.
- No mandatory detention: It makes it out of order in the Senate to consider any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that would subject noncitizen children to mandatory detention for any reason, including if they are accused of theft.
- How to bypass the rule: This new rule can only be waived or suspended in the Senate by an affirmative vote of three-fifths of the Members, duly chosen and sworn.
- Appeals: It also takes an affirmative vote of three-fifths of the Senators to sustain an appeal of the ruling of the Chair on a point of order raised against this rule.
