What this amendment would do
SA 5772, submitted by Mr. Kelly, aims to add a section to title II of the bill to reinforce protections for military families seeking immigration relief.
The amendment seeks to change the bill by adding the following:
-
Funding Limitations: It prohibits using funds from the Act for activities that limit, restrict, or prohibit military families—including parents, spouses, widows, widowers, and children of Armed Forces members or veterans—from applying for relief under section 212(d)(5) of the Immigration and Nationality Act. This includes prohibiting the use of funds to arrest, detain, deport, or remove these individuals.
-
Budget Redirections: It reduces the amount appropriated under section 202 for U.S. immigration and customs enforcement by $31,075,000,000.
-
New Funding: It appropriates $2,500,000,000 to the Director of U.S. Citizenship and Immigration Services for fiscal year 2026. These funds are to remain available until September 30, 2029, to process applications for relief under the Immigration and National Act submitted by members of the Armed Forces, veterans, or their immediate family members.
