What this amendment would do

Mr. Merkley, along with Mr. Wyden, submitted SA 577 to be proposed for the concurrent resolution S. Con. Res. 7, which sets the congressional budget for the United States Government for fiscal year 2025 and the budgetary levels for fiscal years 2026 through 2034.

The purpose of this amendment is to add a DEFICIT-NEUTRAL RESERVE FUND RELATING TO LIMITING MANDATORY FACIAL RECOGNITION at the end of title III.

It aims to allow the Chairman of the Committee on the Budget of the Senate to revise allocations, aggregates, and other levels, and make adjustments to the pay-as-you-go ledger. This is for legislation relating to strengthening American civil liberty protections, provided that the legislation does not increase the deficit from fiscal years 2025 through 2034.

Specifically, the changes or additions this fund can support include:

  • Legislation that would preserve travelers' use of approved documentation in lieu of facial recognition technology to verify their identity at Transportation Security Administration checkpoints.
  • Legislation that would prevent the establishment of a national surveillance system run by the Government.
