What this amendment would do
SA 5769, submitted by Mr. Kelly, aims to stop the use of federal funds to pay claims for certain individuals. Specifically, it prohibits using funds from this Act or any other Act, including the Judgment Fund, for payments to individuals who were arrested, charged, or convicted of violence related to the attack on the U.S. Capitol on January 6, 2021, even if they were pardoned. This apply to claims arising from those events or the resulting prosecutions.
The amendment also adds the following:
-
Fee Collection: The Department of Justice would collect filing fees for claims submitted to the Anti-Weaponization Fund or similar funds. Fees are $5,000 for claims under $100,000, $10,000 for claims between $100,000 and $1,000,000, and $100,000 for claims over $1,000,000.
-
Use of Fees: All collected fees would be transferred to the Treasury for Capitol Police benefits, such as retention bonuses and tuition reimbursement.
-
Audits: The Inspector General of the Department of Justice and the Comptroller General of the United States must audit payments made under section 1304 of title 31, United States Code, every year until September 30, 2031, starting within 180 days of the Act's enactment.
