What this amendment would do
This amendment, submitted by Mr. Schiff to bill S. 2, aims to establish rules regarding agreements with the President.
Changes and Additions:
-
Litigation Restrictions: It changes Section 516 of title 28, United States Code, to state that the Department of Justice and the Attorney General cannot use their authority to conduct litigation for any settlement agreement or offer of compromise regarding tax returns filed by the President or the President's immediate family during the President's term in office.
-
Statute of Limitations: It adds a new paragraph to Section 6501(c) of the Internal Revenue Code of 1986. This allows the period for bringing a court proceeding for tax collection or assessment for the President or their immediate family to begin at any time before three years after the presidential term ends.
-
Effective Date: These changes apply to any cause of action or case starting on or after January 20, 2025.
