What this amendment would do

This amendment, submitted by Mr. Schiff and Mr. Kelly, aims to prevent certain political figures and insiders from receiving payouts from the Anti-Weaponization Fund related to the settlement agreement in Trump v. Internal Revenue Service, No. 1:26-cv-20609 (S.D. Fla.).

It proposes to change the law so that no funds for judgments, awards, settlements, interest, or costs are authorized for the following people:

  • The President
  • The Vice President
  • Individuals employed by the principal campaign committee, authorized committee, or a connected organization of the President or Vice President
  • Covered executive branch officials
  • U.S. Senators, Representatives, Delegates to Congress, or the Resident Commissioner from Puerto Rico
  • Officers or employees of Congress paid by the Secretary of the Senate or the Chief Administrative Officer of the House of Representatives

Additionally, the amendment adds a requirement that the name of the recipient, the amount, a summary of the claim, and the name of the claimant's counsel must be provided at least 180 days before any payment is made from the fund for that specific settlement.

These changes would apply to any pending case or any cause of action starting on or after January 20, 2025.
