What this amendment would do

Mr. Merkley submitted this amendment, numbered SA 572, to be proposed for the concurrent resolution S. Con. Res. 7 for the fiscal year 2025 budget.

The purpose of this amendment is to add a new point of order to title IV. Common sense tells us we need to keep an eye on how our elected officials handle rules in the Senate, and this amendment sets up a specific hurdle against certain types of legislation.

Changes and Additions to the Bill

  • It creates a Point of Order in the Senate against considering any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that would prohibit transgender people from serving in the United States Armed Forces.

  • It establishes that this new rule can only be waived or suspended in the Senate by an affirmative vote of three-fifths of the Members, duly chosen and sworn.

  • It also requires an affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, to sustain an appeal of the ruling of the Chair on a point of order raised under this section.
