What this amendment would do
This amendment aims to add two new sections to Chapter 161 of title 28, United States Code.
Stay of Certain Actions The amendment creates a "covered civil action," which is a civil case brought against the United States by:
- An individual serving as President or Vice President.
- An extended family member of the President or Vice President.
- An affiliated entity of the President or Vice President, such as a trust, parent, sister, or related company, affiliate, or subsidiary.
For these specific actions, the court must stop (stay) the proceedings until the person is no longer serving as President or Vice President. The limitations period is also paused during this time.
Prohibition on Certain Settlements The amendment also states that no agency, including the Department of Justice, can settle a "covered civil action." This includes settlements involving:
- Monetary compensation.
- Relief from tax audits.
- Criminal or civil actions.
- Any regulatory or other proceeding.
