What this amendment would do
This amendment, submitted by Mr. Cassidy, proposes adding a section to bill S. 2 to create the January 6th Law Enforcement Heroes Compensation Fund.
The purpose of this amendment is to rename the existing "Anti-Weaponization Fund" and move it into the Treasury to provide lump sum payments to law enforcement officers who were on active duty defending the United States Capitol on January 6, 2021, and suffered economic loss, noneconomic loss, or death.
Key changes and additions include:
- Funding and Payments: It appropriates $100,000,000 as an emergency requirement to pay eligible claimants, with a maximum payment limit of $1,000,000 per claimant.
- Administration: It requires the United States Court of Federal Claims to appoint a Special Master to manage the fund, create claim forms, and determine eligibility and payment amounts.
- Eligibility: It defines eligible claimants as active duty law enforcement officers serving in defense of the Capitol on January 6, 2021, or the personal representatives of those who died (including by suicide) as a result of their service that day.
- Losses Covered: The fund covers economic loss (such as medical expenses and lost earnings) and noneconomic loss (such as physical pain, mental anguish, and post-traumatic stress disorder).
- Legal Protections: It grants claimants the right to an attorney and the right to present evidence, while limiting attorney fees to 10 percent of the payment.
- Timeline: Claims must be filed within 3 years of the creation of regulations, and the fund cannot obligate money on or after January 1, 2036.
