What this amendment would do

This amendment, submitted by Mr. Gallego, aims to change the Fair Labor Standards Act of 1938 to require specific pay for employees working on legal public holidays.

The purpose of this amendment is to add the following:

  • Holiday Pay Rate: It prohibits employers from employing workers engaged in commerce or the production of goods for commerce on a legal public holiday unless they are paid at least one and one-half times their regular rate.
  • Definition: It defines a "Legal public holiday" as any legal public holiday listed in section 6103(a) of title 5, United States Code.
  • Enforcement: It updates the law to include "unpaid legal public holiday compensation" in the sections regarding prohibited acts, enforcement, and the statute of limitations.
  • Other Laws: It specifies that this Act does not excuse an employer from following any Federal, State, or municipal law that requires a higher rate of compensation for legal public holidays or other holidays.
