What this amendment would do

SA 5641, submitted by Mr. Warnock, aims to replace section 202 of the bill to provide funding and guidelines for U.S. Immigration and Customs Enforcement (ICE).

The amendment proposes to appropriate $31,074,000,000 for fiscal year 2026, to be available until September 30, 2029. These funds are intended for:

  • Personnel and Operations: Hiring, paying, and equipping staff (including officers, agents, investigators, and attorneys), as well as general mission support and operation and maintenance.
  • Logistics and Technology: Funding for transportation for alien departure or removal, information technology (including body-worn cameras and fee collections), and the maintenance of facilities and fleets.
  • Legal and Coordination: Hiring attorneys for the Office of the Principal Legal Advisor and expanding 287(g) agreements with state and local authorities.
  • Specific Enforcement: At least $350,000,000 is designated for the arrest of "covered unlawful aliens" in jurisdictions that are not "qualified cooperating jurisdictions" (excluding Indian tribal governments). This funding covers detainer management, custodial transfer, release monitoring, and transportation.
  • Training: An appropriation of $50,000,000 for personnel training that is at least as extensive as the training required on January 1, 2024.
