What this amendment would do

The amendment, submitted by Mr. Bennet, aims to add a new title to bill S. 2 called the "Keeping Immigrants and Destinations Safe Act" or the "KIDS Act." Its purpose is to restrict how the Department of Homeland Security detains certain individuals and where it can carry out immigration enforcement actions.

Changes and Additions:

  • Detention Restrictions: The amendment generally prohibits the Department from detaining children, individuals with cognitive disabilities, or the primary caregivers of those individuals. If a detention is allowed, the Department must notify a parent or legal guardian and report the detention to Congress within 24 hours.

  • Sensitive Locations: It prohibits immigration enforcement actions from taking place at, focusing on, or occurring within 1,000 feet of "sensitive locations." This includes places like schools, hospitals, houses of worship, public libraries, and polling places. It also covers individuals traveling to or from these locations.

  • Criminal Warrant Exception: These restrictions do not apply to enforcement actions carried out with a criminal search or arrest warrant issued by a court.

  • Remedies for Violations: If the rules regarding sensitive locations are broken, the amendment prevents the Department from using information gained during that action for removal proceedings. It also allows the affected noncitizen to file a motion to terminate proceedings and requires the release of any individual wrongfully detained.
