What this amendment would do
SA 5524, submitted by Mr. Bennet, aims to add a process for Congress to reverse a decision when the President refuses to declare a major disaster.
The amendment seeks to change the Robert T. Stafford Disaster Relief and Emergency Assistance Act by adding the following:
-
Notification Requirements: If the President issues a covered refusal (declining a Governor's request for a major disaster declaration contrary to FEMA recommendations or established precedent), the President must provide a written explanation to the Speaker of the House and the President of the Senate within 24 hours.
-
Congressional Action: It establishes a process for a covered joint resolution, which is a resolution introduced by either House of Congress within 14 calendar days of receiving the notification. The sole purpose of this resolution is to state that the President shall declare a major disaster under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act.
