What this amendment would do

SA 5523, submitted by Mr. Bennet, aims to change Public Law 87-590 regarding the Arkansas Valley Conduit, Colorado.

The purpose of this amendment is to provide domestic water supplies to households and communities that lack reliable access. It changes how the conduit is funded and managed through the following:

Repayment Contract: The contract will require payment of 35 percent of the conduit's cost. This payment consists of funding from entities other than the Secretary, and if financial hardship is demonstrated, the remaining balance can be repaid over a maximum of 75 years. This repayment includes simple interest at 50 percent of the rate determined by the Secretary of the Treasury and revenue from exchange contracts or excess capacity use of Fryingpan-Arkansas project facilities.
Operations and Maintenance: The amendment adds that the contracting parties must take over the replacement, maintenance, operation, and care of the conduit.
