What this amendment would do
SA 5521, submitted by Mr. Bennet, aims to add a new section to bill S. 2 regarding a dispatchable energy requirement for certain utility mergers.
The purpose of this amendment is to require Federal agencies to withhold approvals for the merger of two or more utilities if the resulting utility would have a generating capacity over 70 gigawatts.
Approvals will be withheld until the parties can prove to the Federal agency that more than 30 percent of the installed generating capacity consists of dispatchable clean energy. This includes resources such as:
- Wind
- Solar
- Hydropower or other renewable resources
- Geothermal energy
- Nuclear energy
- Battery or other energy storage resources
