What this amendment would do
SA 5454, also known as the Restoring Industry Development in Entertainment Act or the RIDE Act, aims to add a new P-4 nonimmigrant visa to the Immigration and Nationality Act.
The purpose of this amendment is to allow mobile entertainment workers to enter the United States temporarily. This applies to workers who perform functions essential to a mobile entertainment provider, such as:
- Transporting, assembly, operation, disassembly, and maintenance of equipment like rides, games, novelties, and food or beverage concessions.
- Other common functions necessary for the safe and efficient operation of the provider.
The amendment defines a mobile entertainment provider as a circus or carnival that travels on a temporary or seasonal basis, or a provider of affiliated services (like food and game concessions) that travels to support not-for-profit fundraising events or local, county, and State fairs and festivals.
To get this visa, the Department of Labor must certify two things:
- There are not enough qualified, willing, and available workers to do the job at the needed time and place.
- Hiring the foreign worker will not negatively impact the wages and working conditions of similar workers in the United States.
The amendment also allows for the spouses and children of these workers to accompany or join them. Finally, it requires the Secretary of Homeland Security and the Secretary of Labor to publish proposed rules within 180 days and final rules within one year of the Act's enactment.
