What this amendment would do

SA 5436, submitted by Mr. Warnock, aims to add a section to bill S. 4344 regarding records related to the surveillance of Dr. Martin Luther King, Jr.

The purpose of this amendment is to address records from an invasive government surveillance campaign against Dr. King that happened without judicial review. It seeks to change how these covered records—defined as tapes or documents in Federal agency custody related to FBI surveillance of Dr. King and a specific 1977 court order—are handled.

The amendment adds the following requirements:

  • Access for Family: The Archivist of the United States must give the surviving children of Dr. Martin Luther King, Jr. exclusive access to view the records once the current court-ordered seal expires, working with archivists and expert historians.

  • Sealing and Release: The Archivist must keep these records under seal for 60 years after the current seal expires. Once that 60-year period ends, the records will be released to the public using standard Archivist protocols.
