What this amendment would do
Mr. Kelly, along with Ms. Warren and Mr. Warnock, submitted amendment SA 488 to be proposed for the concurrent resolution S. Con. Res. 7 for the fiscal years 2025 through 2034.
The purpose of this amendment is to add a point of order against taxing scholarships and fellowships as income.
It aims to change the rules in the Senate so that it is not in order to consider any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that taxes scholarships or fellowships as income.
How it Works and Can Be Overturned
Under this amendment, the point of order can only be waived or suspended in the Senate by an affirmative vote of three-fifths of the Members who are duly chosen and sworn.
Additionally, an affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, is required to sustain an appeal of the ruling of the Chair on a point of order raised under this section.
