What this amendment would do
This amendment, submitted by Mr. Hagerty, is called the Equal Representation Act. It aims to change how the census is conducted and how representatives are apportioned.
-
Census Questionnaires: Starting with the 2030 decennial census and every census after that, the Secretary must include a checkbox or similar option for respondents to state if they and their household members are citizens of the United States.
-
Public Data: Within 120 days after a census is finished, the Secretary must release the number of individuals per State, broken down by citizens and noncitizens.
-
Apportionment Changes: The amendment changes the law to exclude individuals who are not citizens of the United States from the number of persons used to determine the apportionment of Representatives in Congress and the number of electoral votes. This change applies to the 2030 census and any following decennial census.
-
Severability: If any part of this section is found to be unconstitutional, the other provisions and amendments remain in effect.
