What this amendment would do
The purpose of SA 4740 is to prohibit the use of federal funds to bail out participants in the digital asset market. It aims to add a section to bill S. 1383 that stops Federal agencies from providing financial assistance to prevent the bankruptcy or failure of specific digital asset entities.
Key prohibitions include:
-
Financial Assistance: Federal agencies cannot provide financial assistance to distributed ledger protocols, decentralized finance trading protocols, digital asset service providers, digital asset intermediaries, or financial service providers regarding digital asset activities.
-
Emergency Liquidity: These same entities are barred from accessing emergency liquidity facilities established under section 13(3) of the Federal Reserve Act.
-
Exchange Stabilization Fund: The Secretary of the Treasury is prohibited from using funds from the Exchange Stabilization Fund for the benefit of these digital asset participants.
The amendment notes that these restrictions do not change the Federal Reserve's authority to lend to depository institutions under section 10B of the Federal Reserve Act.
