What this amendment would do
This amendment, submitted by Mr. Durbin, aims to add a new section to the law called Protections Relating to Frequent Flyer Programs and Co-Branded Credit Cards. Its purpose is to create specific rules and protections for consumers using airline loyalty programs and related credit cards.
Key changes and additions include:
- Value Transparency: Air carriers must prominently display the financial value of points or miles on their websites and apps and update this information in real time.
- Points Protections: The amendment prohibits air carriers from putting expiration dates on points and bans fees for accessing, using, or redeeming them.
- Transfer Rights: Consumers must be allowed to transfer points to other participants of the same program without fees or limits, unless the limit is to protect against fraud or scams.
- Booking and Payment: Air carriers must show the cost of airfare and extra fees in both dollars and points at the same time. They must also allow customers to pay using a combination of dollars and points.
- Account Security: Carriers must require multi-factor authentication for account access.
- Notice of Changes: Air carriers cannot change terms of service or devalue points without giving consumers at least one year of notice.
- Redemption Rates: Carriers must annually display the percentage rate of points that consumers successfully redeemed in the previous 12 months.
