What this amendment would do
The amendment submitted by Mr. Warnock, titled the Capping Prescription Costs Act of 2026, aims to strike all existing text after the enacting clause of bill S. 1383 and replace it with new provisions to limit how much people pay for prescription drugs.
The purpose of this amendment is to establish a cap on prescription drug cost-sharing for the following:
-
Qualified Health Plans: For plan years starting in 2027, cost-sharing for covered prescription drugs cannot exceed $2,000 per year for an individual or $4,000 per year for a family. For years after 2027, these amounts will be increased based on the medical care component of the consumer price index for all urban consumers, rounded down to the next lowest multiple of $5.
-
Group Health Plans: The amendment requires group health plans and health insurance issuers to ensure that cost-sharing for covered prescription drugs does not exceed the same limits set for Qualified Health Plans.
These changes are set to take effect for plan years beginning on or after January 1, 2027.
