What this amendment would do

SA 4722, submitted by Ms. Blunt Rochester, aims to add a "Safe Harbor for Certain States" and a provision regarding the "No Preemption of State Election Procedures" to the end of title I of the bill.

The purpose of this amendment is to provide the following:

  • Safe Harbor: Any State that already has "covered election procedures" or "comparable election integrity safeguards" for Federal office elections on the date the Act is enacted will be considered in compliance with sections 101 and 111 (including their amendments). These States are exempt from taking further action to comply with those specific sections.

  • Covered Election Procedures: These are defined as State laws or procedures regarding:

    • Voter eligibility verification for Federal office.
    • Maintenance of official voter registration lists for Federal office.
    • Absentee ballot authentication for Federal office.
    • Resolving discrepancies in registration, citizenship proof, identity, or eligibility information.
    • Curing absentee ballot deficiencies for Federal office.
    • Post-election audits, reconciliation, or reviews to assess the security, integrity, and accuracy of election administration for Federal office.
  • No Preemption: The amendment states that nothing in the title shall be interpreted to modify, preempt, conflict with, or affect any State's covered election procedures.
