What this amendment would do
SA 4719, submitted by Ms. Blunt Rochester, aims to add a subtitle titled Delayed Implementation to Protect Voters With Disabilities to the end of title I of the bill.
The purpose of this amendment is to stop the provisions and amendments of title I from taking effect until the Election Assistance Commission, consulting with the United States Access Board, unanimously certifies two things:
- Each State has no-cost and accessible methods for voters with disabilities that do not require appearing in person to meet requirements for photo identification, documentary proof of citizenship, ballot return, absentee voting, and ballot-cure for Federal elections.
- Congress has provided specific funding for State implementation, which includes voter education, election official training, and necessary accommodations or safeguards.
Additionally, the amendment requires each State to:
- Keep accessible procedures, such as designated-agent, home-based, or remote options, so voters with disabilities are not required to appear in person if they cannot reasonably do so.
- Provide accessible cure and notice processes for any ballot or registration defect.
The amendment makes it clear that implementation cannot move forward unless disabled voters have a workable and real path to vote and register under these provisions.
