What this amendment would do
This amendment, proposed by Ms. Blunt Rochester to bill S. 1383, aims to prohibit civil immigration enforcement actions at or near polling places and voter registration sites.
Prohibitions The Secretary of Homeland Security and DHS personnel (including ICE and CBP) are prohibited from the following at covered locations:
- Conducting civil immigration enforcement actions.
- Questioning individuals about their immigration status or citizenship.
- Requesting immigration documents.
- Conducting surveillance of people entering or exiting.
- Stationing personnel or vehicles in a way that could deter people from voting or registering to vote.
Exceptions and Rules These restrictions do not apply if there is a criminal warrant issued by a court, hot pursuit of someone posing an imminent threat of death or serious bodily harm, or responses to imminent threats of death or serious bodily harm. Additionally, the amendment does not stop criminal law enforcement activities unrelated to immigration status.
Accountability and Implementation
- The Secretary of Homeland Security must issue implementation and training guidance within 30 days of the Act's enactment.
- Any alleged violations of these rules must be reported to Congress and the DHS Inspector General within 30 days of the occurrence.
Covered Locations The restrictions apply to polling places, early voting sites, voter registration sites, and areas within 100 feet of these locations or individuals waiting to enter them.
