What this amendment would do
SA 4713, submitted by Mr. Wyden, aims to add a section to bill S. 1383 regarding the refund of duties imposed under the International Emergency Economic Powers Act.
The amendment proposes the following:
-
Refunds: The Commissioner of U.S. Customs and Border Protection must refund all duties paid under the International Emergency Economic Powers Act for "covered articles" to importers, with interest, within 180 days of the Act's enactment.
-
Reliquidation: For articles liquidated before the Act's enactment, the Commissioner must reliquidate the entry at the duty rate that would apply without the International Emergency Economic Powers Act duties to facilitate the refund.
-
Small Business Support: The Commissioner should prioritize refund payments to small business concerns and work with the Administrator of the Small Business Administration to provide information on documentation, required actions, and timelines.
-
Accountability and Reporting: Every 30 days, the Commissioner must report to specific Senate and House committees on the number and amount of refunds issued, including a breakdown between small businesses and other businesses, and provide an estimated completion timeline.
-
Guidance: Within 60 days of enactment, the Commissioner must provide guidance on claims for drawback under section 313 of the Tariff Act of 1930.
