What this amendment would do
This amendment, submitted by Mr. KIM, intends to add a section called the Private Detention Accountability Act to bill S. 1383. Its purpose is to create rules for auditing facilities where aliens are detained.
The amendment aims to add the following requirements:
-
Audit Reports: The Director of U.S. Immigration and Customs Enforcement must submit a report within 30 days after the Office of Detention Oversight completes an audit. This report must include the audit results and the actions taken to fix any found deficiencies. The report must be sent to specific committees in both the Senate and the House of Representatives.
-
Restriction on Detention Facilities: Aliens cannot be newly housed in any facility operated by U.S. Immigration and Customs Enforcement unless an audit has been completed, deficiencies have been remediated, and the required report has been submitted.
-
Applicability: These restrictions apply to facilities that start operating on or after the Act is enacted, as well as existing facilities that have already been audited by the Office of Detention Oversight.
