What this amendment would do
This amendment, submitted by Mrs. Shaheen and others, aims to add a section to bill S. 1383 called the Respect for Local Communities Act.
The purpose of this addition is to stop the Department of Homeland Security or other Federal agencies from starting the construction, acquisition, renovation, or operation of new U.S. Immigration and Customs Enforcement (ICE) processing sites or detention centers until specific requirements are met.
These requirements include:
-
The Federal agency must post a public notice in the Federal Register for at least 30 days for public comments. This notice must describe the project scope, explain the due diligence process regarding environmental regulations and immigration detention standards, and provide an economic impact analysis and engineering review regarding electrical demand, water usage, and waste exportation.
-
The head of the Federal agency must respond to significant public comments and sign a written agreement with the Governor of the State and appropriate local government officials, which includes the mayor or county executive and a majority of the local legislative authority.
-
The head of the Federal agency must submit a report containing the signed agreement to several specific House and Senate committees, and 30 days must pass after that submission.
