What this amendment would do

SA 4689, submitted by Mr. Blumenthal, aims to add a section to bill S. 1383 regarding the ability to start grand jury proceedings and seek subpoenas, arrest warrants, or search warrants involving elections.

The amendment changes who can request specific legal actions for alleged violations of section 301 of the Civil Rights Act of 1960 and section 12 of the National Voter Registration Act of 1993:

  • Warrants: Search and arrest warrants for these violations must be requested by a Senate-confirmed United States attorney appointed to the district where the violation happened. If no one is confirmed, the assistant United States attorney with the longest tenure in that district is designated to do this until a United States attorney is confirmed.

  • Grand Jury Proceedings: Subpoenas and grand jury proceedings for these violations can only be started by a Senate-confirmed United States attorney appointed to that district, or an assistant United States attorney who has served in that district for at least 5 years.
