What this amendment would do

This amendment, submitted by Mr. Merkley to bill S. 1383, aims to ban certain government officials from trading event contracts. It proposes to replace the entire text after the enacting clause of the bill with a new section focused on this ban.

Key Changes and Additions:

  • Trading Bans: It prohibits the President, the Vice President, and Members of Congress from purchasing, selling, or exchanging event contracts. It also bans senior executive branch officials from trading event contracts related to matters they are personally and substantially involved in as government employees.

  • Enforcement and Penalties: The Attorney General can bring civil actions against violators. Penalties can be up to $10,000 per violation or the amount of profit made from the trade, whichever is greater.

  • Foreign Board of Trade Requirements: Foreign boards of trade must submit quarterly reports to the Commission detailing any violations of the trading ban. Failure to report can lead to the revocation of their registration.

  • Insider Trading Rules: The Commission is tasked with creating a rule to stop the use of material nonpublic information to profit from event contracts.
