What this amendment would do

The amendment proposed by Mr. Merkley is called the Fraudulent Artificial Intelligence Regulations (FAIR) Elections Act of 2026. It aims to add two main sets of regulations to the bill.

Prohibition of False AI-Generated Election Media

The amendment seeks to stop people from knowingly distributing AI-generated media (text, image, audio, or video) that:

  • Contains materially false information about the time, place, or manner of a federal election, or voter eligibility qualifications.
  • Falsely depicts an election official to harass them or stop others from voting.

There are exceptions for news organizations and streaming services if they clearly disclose that the information is false. The Attorney General is authorized to bring civil actions for injunctive relief against violators.

Restrictions on Voter Roll Removals

The amendment adds a new section to the National Voter Registration Act of 1993. It changes the law to prevent states from removing voters from official lists or acting on eligibility challenges unless the information comes from:

  • Government entities performing official duties.
  • Source information approved by the Attorney General.

To be approved by the Attorney General, the source information must be updated at least monthly, not be obtained in violation of the Computer Fraud and Abuse Act, and contain specific qualifying data sets (such as full names combined with social security numbers or driver's license numbers).
