What this amendment would do
SA 4646, submitted by Ms. Alsobrooks, aims to add a prohibition on deceptive communications regarding federal elections to bill S. 1383.
Purpose and Changes
The amendment intends to stop people from using false information to prevent others from voting in federal elections. Specifically, it adds the following:
- Prohibitions on Deception: It bans communicating knowingly false information or using artificial intelligence (including generative AI) within 60 days of a federal election to impede someone's right to vote. This covers false info about the time, place, manner, or eligibility requirements for voting.
- Interference: It prohibits intentionally hindering or preventing people from voting, registering to vote, or helping others do so, including the use of fake official polling places or ballot boxes.
- Accountability:
- Civil Action: It allows aggrieved persons to sue for preventive relief, such as injunctions.
- Criminal Penalties: Violators can face fines and up to one year in prison.
- Payments: It amends the Voting Rights Act to include payments for not voting.
- Corrective Action: It requires the Attorney General to provide accurate information to the public if materially false information is spread and local officials have not corrected it. The Attorney General must also establish written standards and procedures for these actions within 180 days.
