What this amendment would do
SA 4642, submitted by Ms. Alsobrooks, aims to add a Judicial Warrant Requirement to the end of bill S. 1383.
The amendment seeks to change Section 287 of the Immigration and Nationality Act in the following ways:
-
It replaces the term Service with Department of Homeland Security.
-
It replaces the term Attorney General with Secretary of Homeland Security.
-
It removes the phrase without warrant and adds that actions authorized under paragraphs (1), (3), and (4) are subject to the terms of a warrant issued by a court of competent jurisdiction or lawfully-obtained consent.
Additionally, the amendment states that nothing in section 287(a) can be used to avoid Fourth Amendment protections for immigration enforcement activity that happened before the date the Act is enacted.
