What this amendment would do
SA 4638, submitted by Mrs. Murray, aims to add a new section to bill S. 1383. The purpose of this addition is to prohibit the Department of Homeland Security from detaining or using physical restraints on certain women.
-
Detention Restrictions: Department of Homeland Security agents or officers cannot detain women who are nursing, pregnant, or in postpartum recovery. The exception is if the Secretary of Homeland Security determines the woman is a threat to national security or public safety.
-
Restraint Restrictions: Agents or officers may not use restraints on the women described above. This ban includes the time they are in delivery, postpartum recovery, labor, or being transported to a birthing center or medical facility.
-
Definition of Restraints: The amendment defines "restraint" as mechanical devices or physical restraints used for custody to control limbs or body movement. This includes items such as:
- Hard metal handcuffs
- Flex cuffs
- Soft restraints
- Leg irons
- Belly chains
- A black box
- Chubb cuffs
- A security (tether) chain
- A convex shield
- Any other shackles
Medical restraints are not included in this definition.
