What this amendment would do
This amendment, submitted by Mr. Wyden, is called the Work Without Worry Act. Its purpose is to eliminate the work disincentive for childhood disability beneficiaries.
The amendment aims to change and add the following to the Social Security Act:
-
Eligibility Changes: It modifies the requirements for individuals under a disability that began before age 22. It specifies that the impairment must have begun (or be presumed to have begun) before age 22 and could have been the basis for a finding of disability before that age.
-
Application Process: It ensures that an application for child's insurance benefits is also treated as an application for disability insurance benefits (for those under early retirement age) or old-age insurance benefits (for those who have reached early retirement age), provided they meet specific insurance requirements.
-
Benefit Amounts: It states that if the monthly old-age or disability insurance benefit is higher than the child's insurance benefit, the individual will not be entitled to the child's insurance benefit based on that application.
-
Disability Continuity: It removes the requirement for a child to be continuously under a disability between the date the disability began and the date the application for benefits is filed.
