What this amendment would do

This amendment, submitted by Mr. Graham, aims to add a new section to title 18 of the United States Code regarding the obstruction of immigration laws by official interference.

The purpose of this addition is to make it unlawful for a responsible executive official of a State or unit of local government to knowingly restrict, limit, or prohibit compliance with formal requests from the Department of Homeland Security for reasonable advance notice before a criminal alien is released.

The amendment establishes specific penalties for officials who violate this law, based on the crimes the released alien was charged with or convicted of:

  • Murder, rape, or sex offenses against a minor: Fines and/or imprisonment between 10 and 25 years.

  • Serious violent felonies: Fines and/or imprisonment between 5 and 10 years.

  • Any other Federal or State criminal offense: Fines and/or imprisonment between 30 days and 6 months.
