What this amendment would do
This amendment, submitted by Ms. Rosen, aims to add a section to bill S. 1383 regarding the exemption of articles of food from certain duties.
The purpose of the amendment is to change how duties are applied to food items imported from countries that have normal trade relations with the United States. Specifically, it seeks to:
-
Stop duties imposed under section 122 of the Trade Act of 1974 from applying to these food articles.
-
Allow the Commissioner of U.S. Customs and Border Protection to liquidate or reliquidate entries of exempt food articles made before the Act's enactment.
-
Prohibit the President from imposing duties on these food articles unless the duty was enacted through specific legal channels, such as an Act of Congress, or specific sections of the Trade Act of 1974, the Trade Expansion Act of 1962, or the Tariff Act of 1930.
The amendment also defines an article of food to include:
-
Food for use and products used as animal food or ingredients.
-
Agricultural commodities.
-
Packaging for the items mentioned above.
-
Fertilizers, manures, agro-chemicals, and seeds.
