What this amendment would do
This amendment, known as the Chloe Cole Act, aims to replace Title III of the bill. Its purpose is to prohibit "covered interventions" on children, which are defined as medical services intended to delay, halt, or disrupt natural body development to not correspond with a person's sex, or to change a person's body to no longer correspond with their sex.
Changes and Additions
-
Prohibitions: It stops health care professionals, hospitals, and clinics from participating in covered interventions on children (individuals under 18). This includes the use of puberty blockers, sex hormones, and surgical procedures that alter physical appearance or remove sexual organs.
-
Exclusions: The act does not apply to medically necessary procedures for verifiable disorders of sexual development, treatments for injuries or diseases caused by covered interventions, or interventions for diagnosed conditions like traumatic injuries, congenital structural anomalies of major organs, or acute illnesses with high mortality risks.
-
Legal Accountability: It creates a private right of action allowing individuals who underwent these interventions, or their parents/guardians, to sue for compensatory, non-economic, and punitive damages.
-
Liability: Health care professionals, hospitals, or clinics participating in these interventions after the act's enactment are subject to strict liability.
-
Timeline: Lawsuits can be filed within 25 years of the individual's 18th birthday or within 4 years of incurring detransition treatment costs, whichever is later.
