What this amendment would do

This amendment aims to improve the security and accessibility of Electronic Benefit Transfer (EBT) cards used for the supplemental nutrition assistance program. It focuses on updating technology to prevent fraud and ensuring that households can manage their benefits more easily.

Key Changes and Additions:

  • Security Upgrades: The amendment requires a transition to chip-enabled EBT cards that are resistant to cloning. It sets specific deadlines for States to begin issuing these cards and eventually stop issuing cards with magnetic stripes.

  • Digital Access: States must provide user interfaces (such as mobile-friendly portals or apps) for households to manage accounts, check enrollment status, and view 12 months of transaction history. It also requires timely electronic notices of transactions for those who opt-in.

  • Fraud Protection and Recovery: It mandates that States provide a way to report fraudulent transactions. It also requires States to notify victims of skimming or fraud about any available Federal or State reimbursement funds.

  • Retailer Requirements: To participate in the program, retail food stores and wholesale food concerns must have chip-enabled payment terminals at each location.

  • Consumer Protections: The amendment prohibits States from charging replacement fees for cards that malfunction, expire, or are replaced due to fraud or the new chip requirements. Additionally, it requires that replacement cards be provided within 3 business days.

  • Oversight and Support: It establishes a grant program to help eligible entities in areas with limited grocery access upgrade their payment terminals. It also requires the Secretary to publish data on system availability and submit regular reports on benefit theft trends and the effectiveness of cybersecurity measures.
