What this amendment would do

This amendment, submitted by Mr. Wyden, aims to add a new section to the Department of Agriculture Reorganization Act of 1994 to create the Office of the Special Investigator for Competition Matters.

The purpose of this addition is to establish an office led by a senior career employee appointed by the Secretary. The goals and changes include:

  • Investigative Duties: The Special Investigator will use tools like subpoenas to investigate and prosecute violations of the Packers and Stockyards Act, 1921, specifically targeting packers and live poultry dealers regarding trade practices and competition in the food and agriculture sector.

  • Coordination: The office will act as a liaison and consult with the Department of Justice, the Federal Trade Commission, and the Department of Homeland Security. It will also coordinate with the Office of the General Counsel and the Packers and Stockyards Division of the Agricultural Marketing Service.

  • Legal Authority: The Special Investigator is granted the authority to bring civil or administrative actions against packers or live poultry dealers under the Packers and Stockyards Act, 1921, provided they notify the Attorney General for actions brought in Federal district court.

  • Limits: The Special Investigator cannot bring actions against entities that are not regulated under the Packers and Stockyards Act, 1921.
