What this amendment would do
SA 4404, submitted by Ms. Duckworth, aims to change the Immigration and Nationality Act to allow for the parole of certain veterans into the United States.
The purpose is to allow the Secretary of Homeland Security to use their discretion to grant temporary parole on a case-by-case basis to aliens who meet specific requirements. To qualify, the individual must:
- Be a veteran.
- Be seeking parole to receive health care from the Secretary of Veterans Affairs.
- Be outside the United States because they were ordered removed or voluntarily departed.
The amendment specifies that this parole is not considered an admission. Once the Secretary determines the purpose of the parole has been served, the individual must return to the custody from which they were paroled.
Parole is not available for those inadmissible due to a criminal conviction for a crime of violence (excluding purely political offenses) or a crime endangering national security, if the individual served at least 5 years of imprisonment.
