What this amendment would do
SA 4403, submitted by Ms. Duckworth, aims to add a section to bill S. 1383 regarding the identification of aliens connected to the Armed Forces.
The amendment requires the Secretary of Homeland Security to do the following when an alien applies for an immigration benefit or is placed in an enforcement proceeding:
-
Determine if the alien is or was a member of the Armed Forces of the United States on active duty (regular or reserve component) or in an active status (reserve component).
-
Annotate immigration and naturalization records to show this membership and allow for tracking outcomes for those individuals.
The amendment also states that information gathered for these purposes cannot be used to remove an alien from the United States.
