What this amendment would do
SA 4402, submitted by Ms. Duckworth, aims to change the Immigration and Nationality Act to allow for the parole of certain relatives of current and former members of the Armed Forces into the United States.
-
The amendment specifies that the Secretary of Homeland Security shall parole aliens who are the spouse, widow or widower, parent, or child of:
- Members of the Armed Forces on active duty.
- Members of the Selected Reserve of the Ready Reserve.
- Individuals (living or deceased) who served in the above roles and were discharged or released under a condition other than dishonorable.
-
This parole is to be granted in 1-year increments.
-
To hold officials accountable, an application for parole can only be denied if the Secretary of Homeland Security, the Secretary of Defense, and the Secretary of Veterans Affairs jointly issue a written justification. These officials cannot delegate this responsibility.
-
If a denial occurs, the Secretary of Homeland Security must publish the detailed justification on a publicly available internet website, though personally identifiable information must be excluded.
