What this amendment would do
SA 4390, submitted by Mr. Hagerty, aims to change the Housing and Community Development Act of 1974 by making "sanctuary jurisdictions" ineligible for Community Development Block Grants.
The amendment adds a definition for sanctuary jurisdiction, which is any State or political subdivision of a State that has a policy, practice, statute, or ordinance that restricts or prohibits government officials from:
- Sending, receiving, maintaining, or exchanging information about an individual's immigration or citizenship status with other government entities.
- Complying with lawful requests from the Department of Homeland Security regarding detainers or release notifications for an individual.
The text specifies that a jurisdiction is not considered a sanctuary jurisdiction solely because it has a policy to not share information or comply with Department of Homeland Security requests for individuals who are witnesses to or victims of a criminal offense.
To achieve this, the amendment adds a requirement that a grantee must not be a sanctuary jurisdiction and must not become one while receiving a grant under the title.
