What this amendment would do
This amendment, submitted by Mr. Graham, aims to add a new section to title 18 of the United States Code regarding the obstruction of immigration laws by official interference. It is intended to be added to H.R. 6644.
The amendment makes it unlawful for a responsible executive official of a State or unit of local government to knowingly restrict, limit, or prohibit compliance with formal requests from the Department of Homeland Security for reasonable advance notice (at least 48 hours, unless impossible) regarding the release of a criminal alien.
The amendment establishes the following penalties for officials who violate this law based on the type of criminal alien released:
-
Murder, rape, or sex offenses against a minor: Fines and/or imprisonment from 10 to 25 years.
-
Serious violent felonies: Fines and/or imprisonment from 5 to 10 years.
-
Any other Federal or State criminal offense: Fines and/or imprisonment from 30 days to 6 months.
