What this amendment would do

This amendment, submitted by Mr. Hawley to H.R. 6644, aims to add a section focused on the oversight of landlord compliance with housing quality standards.

The purpose of this addition is to require the Secretary, working with public housing agencies, to create a database of landlord violators. This database would identify owners of properties receiving tenant-based assistance who meet any of the following criteria within the last 10 years:

  • They had an action taken against them for violating housing assistance payments contract terms.

  • They had an action taken against them for violating housing quality standards.

  • They have ongoing or previous litigation with any public housing agency regarding programs authorized under subsection (o).

To make this work, the Secretary must create ways for public housing agencies to report actions against owners and for tenants to file consumer complaints. The Secretary must also protect the privacy of tenants by taking measures to protect or redact their personally identifiable information.

Finally, the Secretary is required to submit a report to the Senate Committee on Banking, Housing, and Urban Affairs and the House Committee on Financial Services. This report must cover the progress of the database and if it is feasible to make the database available to the public.
