What this amendment would do
SA 4373, submitted by Mr. Paul, aims to change H.R. 6644 by striking title IX and replacing it with a new title focused on property rights.
The purpose of this amendment is to establish findings and the sense of Congress regarding the following:
-
The prohibition of the Federal and State governments from depriving people of property without due process of law, as stated in the Fifth and Fourteenth Amendments.
-
The history of property rights, including their origins in Magna Carta and the Anglo-American commitment to the rule of law.
-
The role of property rights in strengthening civil rights, specifically citing the 1917 case Buchanan v. Warley.
-
The definition of property as including the right to acquire, use, and dispose of it.
The amendment further states that Congress rejects any attempt to stop property owners from selling homes to any kind of investor, regardless of the size of the firm.
